Arshad Ghaffar

Arshad is a commercial dispute resolution lawyer. His experience encompasses the full spectrum of the business cycle. Arshad’s focus is international, but he also has English commercial dispute resolution experience, and is a member of the Commercial Court User’s Committee.

His main areas of expertise are commercial and international arbitration, litigation and mediation; European Union; shipping and aviation, and corporate. His cases often involve the interplay between the interpretation of complex commercial contracts and their technical underpinnings, in particular in the context of large infrastructure projects. He has considerable experience of international commercial arbitration at both institutional and ad hoc levels, and has conducted arbitrations under most of the most frequently used institutional rules, including those of the ICC and the LCIA. He is also familiar with the Uncitral Rules.

I recognise that disputes are not always about going to court and as a trained mediator and arbitrator I am very familiar with other ways of resolving disputes that can result in  a satisfactory conclusion without having to go to the court.

I can act as a mediator or an arbitrator or I can advise as a barrister on mediations and arbitrations.

I am a commercial dispute barrister with over 20 years’ experience.  I am also a qualified mediator and arbitrator.  I am familiar with all aspects of company law and a wide range of  commercial disputes including  for example partnership disputes, merchandising rights, assets and share valuation agreements plus of course purely contractual disputes. I act for Directors, shareholders, investors, partners, advisors and individuals involved in disputes arising out of all types of structures from a company limited by guarantee to partnerships.  

In addition to advising on disputes and appearing in court I regularly assist clients with transactional work both on an advisory and drafting basis including drafting standard terms and agreements and general contractual documents.

I speak fluent Urdu and Hindu and I have strong personal and professional links in South Asia and the Middle East.
