Michael Trevelyan

Debt recovery is a very broad specialism which requires an expert. I offer a fixed fee service for your peace of mind, have many years of experience of debt recovery cases and am an extremely effective Barrister in this area. I can represent you in Court, assist you in negotiations, draft documents and advise you throughout your case at an affordable cost whether you are the Claimant or the Defendant.

My chambers are based in Birmingham and I regularly travel throughout the Midlands but am happy to attend any court in England and Wales without charging additional travel costs.

My approach

I am a skilled and experienced Barrister with a thorough knowledge of both law and procedure. Prior to joining the Bar, I worked as an advocate in civil law cases representing a wide range of clients, from individuals to FTSE 100 Companies. Now that I am a Barrister, my work includes contractual disputes and general debt recovery.

I am known for my tenacious but pragmatic approach to litigation, never losing sight of your objectives and am able to assess the best way forward at any stage. I appreciate that, in the current uncertain economic climate, costs are a key issue and I am able to give advice which reflects the reality of litigation whilst also being able to fight for your position in Court or during negotiations.

My work

I can assist, advise and represent you in any of the following matters whether you are a Claimant or a Defendant:

Landlord and Tenant Issues

I have previously acted in many disputes between tenants and their landlords, chiefly arising from non-payment of rent. Whether you are a landlord seeking possession or a tenant faced with a claim for possession, I can represent you in Court.

Small Claims

Money claims with a value of up to £10,000.00 can be dealt with on the small claims track, so despite the name the cases are often anything but small for the parties involved. I have represented both Claimants and Defendants in small claims matters, whether they are individuals or businesses, and am happy to accept instructions for any type of hearing as the claim progresses, all the way up to the final hearing where the claim is decided.

Fast Track Cases

Fast track cases often involve larger sums of money than those dealt with as small claims or are more complex. The Court procedure itself is much more involved than on the small claims track and therefore effective legal advice and representation can be vital to success. I am happy to act for any party in a fast track case and can be instructed for any hearings up to and including the Trial itself.

Enforcement

The Court does not enforce judgments and therefore it is up to the successful party to decide how best to actually get what they are owed. Whether you have won in Court and are attempting to enforce your judgment or you have lost and are now facing enforcement proceedings, I have a wide range of experience in the various enforcement methods including third party debt orders, charging orders, warrants of execution and attachment of earnings orders.

In addition I can assist in representing you at hearings connected to enforcement such as hearings to obtain information from a debtor and interpleader proceedings.

Bankruptcy and Winding Up

Insolvency proceedings are extremely serious and can be an effective way of obtaining money owed from an individual or a company. I am happy to represent you, whether you are a creditor or at risk of insolvency, at all hearings connected to bankruptcy and the winding up of companies including applications to set aside statutory demands, final hearings of bankruptcy petitions and applications for substituted service.

Mortgage Repossessions and Orders for Sale

If you are in arrears with your mortgage, or you owe a debt which is secured on your property, you could face proceedings for repossession and sale. I have acted in mortgage repossession cases and applications for orders for sale involving a wide range of lenders and creditors. I have considerable experience in dealing with such claims and will be happy to represent you so that you have a specialist fighting your case in Court.

In addition to acting for you in the above matters, I am happy to advise and represent you for specific issues such as:

Applications to Set Aside Judgment

Applications to Strike Out

Applications for Relief from Sanctions

Summary Judgment

Disposal Hearings
