Stephen McCaffrey

As a leading regulatory lawyer and professional discipline barrister, I have vast experience in defending all healthcare professionals in all courts and tribunals ranging from doctors, nurses, midwives, pharmacists and other healthcare professionals.

I have been involved in regulatory and disciplinary work for many years and represented hundreds of clients.

I have represented solicitors, accountants, police officers and healthcare professionals including those appearing before the NMC, GMC/MPTS, GPhC or HCPC. I have even represented barristers in relation to the BSB and solictors in relation to the SRA. I have also advised and acted in proceedings brought in the Care Standards Tribunal. I am the founder of separate specialist websites relating to nurses, doctors and other healthcare professionals and advise regularly through them.

Most of my clients now approach me from the outset to assist with case strategy and advice. Many of them do not even know if they are to be charged or brought before any tribunal.

I also currently act for several businesses in an advisory capacity to try and avoid having issues in this field and have spent time specifically advising in relation to CQC inspections. I have been central to setting up a mock inspection team which assists organisations worried about regulatory breaches or professional standards assessments.

My experience includes defending and representing healthcare professionals including issues with registration, complaints, professional competence, health issues and allegations of misconduct.

My approach

I have always made it my priority to be clear, direct and straight forward to deal with. I make sure my focus always remains on the practical implications of everything and the objectives of my clients. I agree clear terms of work and understand what you need – then achieve it.

I generally prefer to become involved in a case as early as possible. Not only does this increase my chances of shaping events to give you the best possible chance of winning but it also allows me to take advantage of every opportunity to stop matters as fast as possible. My goal is always to try and stop a case in its tracks - I am not the sort of barrister to simply sit around and wait for events to happen or for hearing dates to arrive.

I have extensive experience dealing with clients in other businesses and have operated direct access cases for almost 8 years now. I set up one of the first direct access websites and have strict basic rules. The most important one is that I deal with my clients myself – no clerks and no intermediaries - and I am second to none when it comes to client care and dedication to my cases.

I have my own team to assist me who have been selected by me and trained by me. They consist of an administrator, two paralegals and an investigator. I have a 24 hour answering service and am always available to clients in emergencies. However, my clients deal with me direct. Because of this I have a long list of loyal clients who have been with me for years and who refer to me the vast majority of my other work.

I am renowned for being “hands on” with my cases so expect a great deal of communication and rather direct and realistic advice. I will not guarantee things I cannot deliver and I will not waste your time and money - if I don’t think I can help you I will tell you.

I focus on three clear principles:

  • EARLY, CLEAR, DIRECT ADVICE
  • FIXED FEES IN ALL CASES
  • PRACTICAL PLANS TO GET THE RIGHT RESULT.

It all starts with an initial FREE and NO OBLIGATION assessment of your case.

Feel free to make contact.

See below what some of my clients say.

My work

I have represented hundreds of clients in criminal, regulatory and disciplinary cases. All of my work now is through direct access and I have a formidable track record and reputation developed through hard work.

I have represented clients in the criminal courts in just about every offence which exists from minor public order offences up to an including murder although fraud has accounted for the vast majority of work over the last 4 years. However I don’t treat any case or client differently and remain well aware that the repercussions for each client is all that matters to them.

I moved into licensing, disciplinary and regulatory work by accident after clients wanted me to continue to represent them in front of their regulatory bodies or the local authority. Over the last 8 years these have turned into my main areas of practice having built up a strong practice and loyal client following.

I am told it is the knowledge and skills acquired in criminal work which gives the advantage in these cases due to the experience in developing effective case strategy and forensic analysis and cross-examination – not to mention the extensive other advocacy experience.

About me

I am joint head of Kings View Chambers. As a leading regulatory lawyer and professional discipline barrister, I have vast experience in defending all healthcare professionals in all courts and tribunals ranging from doctors, nurses, midwives, pharmacists and other healthcare professionals. I also have over ten years experience dealing with licensing matters whether they be alcohol or entertainment or taxi, private hire licences or operator issues.

Renowned for my ‘hands on’ approach to all cases, I am fast to meet clients and become involved in case strategy and management from the earliest opportunity. This is how I get results. It is my appreciation for client care and dedication to work which explains my loyal following of clients in consultancy and direct access legal work.

What my clients say

“If you are looking for a plain speaking, intelligent, direct and effective barrister to represent your interests and deliver on promises then stop looking because you have just found him. Seriously – don’t bother wasting time looking any further. Stephen was absolutely fantastic at a time when I was in jeopardy of losing my career and possibly even my liberty. He dealt with the criminal side and then the disciplinary side and I cannot fault a single aspect of his representation. I owe him a great deal and will be sending others his way.” - AL, Birmingham.

"I can safely say that without representation from Stephen I had no hope at all - I went from solicitor to solicitor - he won my case. No fuss - just expert, professional and affordable advice." - JB, South London.

“Hi Stephen, Thanks very much for today – and indeed the last 4-weeks – you really did perform extremely well at short notice. I’m not sure if you like receiving compliments (I certainly don’t), but here goes anyway…
I’m very rarely impressed, but your general oratory and quick thinking in court are a pleasure to observe. Not once did you miss a subtle discrepancy or an opportunity to reinforce your central message, and I genuinely had confidence in you.
Thank you for everything you have done for me.”

-AM, Social Worker, HCPC Fitness to Practise Hearing

You were direct, clear and got me to take it seriously. I am so grateful and cannot tell you what this means to me. I had given up on nursing. Now I am back doing a job I love.”

-MD, Nurse, Fitness to Practise Hearing

-RB, Social worker, HCPC Interim Order and Fitness to Practise Hearing

“Stephen – I can honestly say that I am fully satisfied by the service that you have offered. I have a clear feeling that the result achieved is the best that we could ever have hoped for and even better, under the circumstances. You have been very supportive, professional and very effective in your approach during the whole process of dealing with my case, from start to finish. You have an obvious ability to absorb a case in its entirety to then produce a clear analysis to pull out very useful elements, strengths and weakness alike. I believe your very sound and methodical approach has strongly contributed to reach the positive outcome that we have reached. I shall never thank you enough for that. Beyond financial considerations, I could clearly see that to you, this field is your passion and that you will always do all that you can to be of service to your client, even to protect me from myself at times, when required. And one needs to be honest and say that your fees are reasonable and lower than the average on the market. I am very aware that your very competent support and your passion even have been a great part to my success, our success. I am very clear that should I need a lawyer again in future, you would definitely be my first port of call every time.
Please feel free to use my comment for marketing purposes.”
