Dirk van Heck
I have considerable experience of contractual and other commercial disputes, debt recovery and insolvency proceedings, property matters (both commercial and residential, including landlord and tenant disputes, lease extensions, covenants & easements, planning law and trusts of land) and employment issues (including unfair and wrongful dismissal, redundancy, discrimination, whistleblowing, restraint of trade clauses, non-payment of bonuses and other unlawful deductions from pay).
I have acted and advised in disputes for clients ranging from private individuals, through SMEs, to multinationals and from small claims to billion dollar international litigation. Commerciality and client service are central to my approach in every case. I will be friendly and responsive, using common sense and a strong focus on the issues to make your legal representation more cost effective and less stressful. I also have "dual capacity" authorisation, meaning I can undertake litigation on your behalf without a solicitor's involvement - most direct access barristers do not have this.
Shareholder disputes, directors' duties, partnerships, trusts, professional negligence, negligent misrepresentation and fraud, asset tracing and recovery, freezing orders and other injunctions and interim remedies, loan agreements and financial services, agency, bailment, construction disputes, insurance claims, property law, insolvency, enforcement proceedings, costs disputes, international/conflict of laws and human rights.
I started practising as a barrister in Sussex, doing a bit of everything, and more recently spent three years working offshore, handling "big ticket", commercial litigation, returning to London in early 2012. I have a range of experience that is unusual in a modern lawyer. This enables me to think laterally, treat each case individually and comfortably take on any dispute within my areas of practice.
I apply my legal knowledge in my life outside my practice - having been a property developer and invested through my own company, I readily see things from my clients' perspective. I'm also a keen supporter of the performing arts and enjoy travelling, good food and keeping fit.
What my clients say
"My company recently had the privilege of being represented by Dirk in a county court action. He showed a great ability to cut through the issues and focus on the facts. Calm and eloquent, he quickly exposed the smokescreens and inconsistencies put up by the defence and resoundingly won us the day. I would have no hesitation recommending Dirk as an excellent commercial barrister and advocate." - Anthony Dallison, CEO, Fern Marketing Ltd.
"Dear Dirk, I just want to thank you for your assistance in our recent employment tribunal. We were all grateful for your professional yet charming manner throughout the proceedings. You made us feel as though you had a genuine interest in our case and calmly guided us through our first such tribunal, reducing the stress levels by some measure. We felt that you were a 'safe pair of hands', and the icing on the cake at the end of it all was that we won! I will not hesitate to recommend colleagues to you for advice and assistance..." - Colin Farmer FCA, Partner, Alliotts Chartered Accountants and Business Advisors.
"Dirk acted for me on a complicated trust of land case and successfully won the case for me due to his in depth knowledge and professional capability. He is also extremely personable and totally dedicated to his work." - Alison Middleton, homeowner.
