What is a Direct Access barrister?

Direct Access, sometimes called Public Access, is a Bar Standards Board scheme that lets members of the public instruct a barrister directly. You do not need to engage a solicitor first.

Barristers are specialist advocates and advisers. In immigration law, that means counsel who spend their working lives on visa refusals, tribunal appeals, asylum claims and judicial review of Home Office decisions. Can I instruct an immigration barrister without a solicitor?

Yes. Under the Bar Standards Board's Public Access scheme, you can instruct a Direct Access barrister directly, without going through a solicitor first.

A Direct Access immigration barrister can advise you, draft representations and grounds of appeal, and represent you at tribunal hearings. For complex, ongoing casework involving heavy Home Office correspondence and evidence gathering, you may also want a solicitor or an OISC-regulated adviser working alongside the barrister.

How much does an immigration barrister cost?

Immigration barristers usually quote a fixed fee for a defined piece of work, such as drafting grounds of appeal, advising on a refusal letter, or representing you at a First-tier Tribunal hearing.

Hourly rates are also common for advice. You agree the fee with your chosen barrister in writing before any work begins, so you know the cost up front.

How quickly can I get advice on my immigration matter?

Most enquiries are responded to within one working day. Some immigration matters are extremely time-critical, for example an imminent removal, a detention, or an approaching appeal deadline.

Is using a Direct Access barrister cheaper than using a solicitor?

It often is, because you cut out the solicitor's fee. You deal with the barrister directly, so you only pay one set of legal fees rather than two.

That said, a barrister cannot conduct litigation in the same way a solicitor can. For matters with heavy ongoing correspondence and document management, you may still benefit from instructing a solicitor or OISC adviser as well.

Will my barrister represent me at a tribunal hearing?

Yes. Direct Access immigration barristers can represent you at First-tier Tribunal and Upper Tribunal hearings, and can also act in judicial review proceedings in the Administrative Court and Upper Tribunal.

Can a barrister guarantee my visa will be approved or my appeal will succeed?

No barrister can guarantee an outcome. What a specialist immigration barrister can do is give you a realistic assessment of your prospects, identify the strongest grounds available, and present your case as effectively as possible in representations or at a hearing.

Do you charge anything to enquire?

For cases involving substantial ongoing correspondence with the Home Office, extensive evidence gathering, or case management over a long period, you may benefit from a solicitor or OISC-regulated adviser working alongside the barrister.

Can a barrister help my business with a sponsor licence issue?

Yes. Immigration barristers advise employers on sponsor licence applications, compliance visits, licence suspension or revocation, and appeals or judicial review of adverse Home Office sponsor decisions.
