1. About us and these terms
This website is operated by MyBarrister Ltd (“MyBarrister”, “we”, “us” or “our”), a company registered in England and Wales (company number 08136883) with its registered office at 81 Chancery Lane, London.
By accessing or using our website, or by submitting an enquiry through it, you agree to these terms. If you do not agree to them, please do not use our website.
We may update these terms from time to time. The version published on this page when you use the website is the version that applies.
2. What MyBarrister is, and is not
MyBarrister is an online platform that lists barristers who accept work on a Direct Access (also known as Public Access) basis, and that passes the enquiries you submit to the barrister or barristers you or we select.
We are not a firm of solicitors, a barristers’ chambers, or a provider of legal services, and we do not give legal advice. Nothing on this website constitutes legal advice and it should not be relied on as such.
We are not a party to any contract or retainer that you enter into with a barrister. Any barrister you instruct is engaged by you directly. The legal services that barrister provides, and the basis on which they provide them, are governed by that barrister’s own terms of engagement, not by these terms.
Barristers listed on this website are individually regulated by the Bar Standards Board (BSB) and are bound by the BSB Handbook.
3. Submitting an enquiry
Submitting an enquiry through our website is free of charge and places you under no obligation. When you submit an enquiry, you ask us to pass your details and the contents of your enquiry to one or more barristers so that they can consider whether they are able to assist.
We do not guarantee that any barrister will accept your enquiry, respond to it, or be able to take on your matter. A barrister may decline a matter for any number of reasons, including a conflict of interest, their availability, or the nature of the work.
You should only provide the information needed for a barrister to consider your enquiry, and you should avoid sending sensitive details until you have engaged a barrister and can share them securely. Please make sure the information you give us is accurate.
4. Barrister listings
Information about individual barristers, including their experience, areas of practice and fees, is provided by those barristers or their chambers. While we take reasonable care, we do not independently verify and cannot guarantee the accuracy or completeness of that information, and it may change. You should satisfy yourself as to a barrister’s suitability and current details before instructing them.
5. Using our website
You may use our website only for lawful purposes. You agree not to:
- use the website in any way that breaches any applicable law or regulation;
- submit false, misleading or fraudulent enquiries, or impersonate any person;
- attempt to gain unauthorised access to, interfere with, or disrupt the website or any server or network connected to it;
- use any automated system to extract data from the website, or collect barristers’ details for marketing or any other purpose;
- introduce any virus, malware or other harmful material.
6. Intellectual property
All content on this website, including text, graphics, logos and design, is owned by or licensed to us and is protected by intellectual property laws. You may view and print pages for your own personal, non-commercial use, but you may not otherwise copy, reproduce or exploit any part of the website without our prior written permission.
7. Our liability
The website is provided on an “as is” basis. To the fullest extent permitted by law, we exclude all warranties, conditions and representations that are not expressly set out in these terms.
We are not responsible for the acts, omissions, advice or services of any barrister you find or instruct through our website. Your relationship with any such barrister, and any complaint or claim arising from it, is a matter between you and that barrister.
We do not exclude or limit our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
8. Links to other websites
Our website may contain links to third-party websites. Those links are provided for your convenience only. We have no control over the content of those websites and accept no responsibility for them or for any loss arising from your use of them.
9. Privacy and cookies
Our use of your personal data is explained in our Privacy Policy, and our use of cookies is explained in our Cookie Policy. By using our website you consent to that processing and confirm that the data you provide is accurate.
10. Governing law
These terms, and any dispute arising out of or in connection with them or your use of our website, are governed by the law of England and Wales, and you and we agree to the exclusive jurisdiction of the courts of England and Wales.
